WEBSITE TERMS OF USE AND SERVICE AGREEMENT

1. ACCEPTANCE OF TERMS

Welcome to blissmobilesauna.ca (the “Site”), owned and operated by Bliss Sauna Inc. (“we,” “us,” or “the Operator”). By accessing this Site, using our booking engine, or renting our equipment, you agree to be bound by these Terms of Use, our Privacy Policy, and the Rental Agreement (if applicable).

IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE THIS SITE OR OUR SERVICES.

2. INTERNET SALES CONTRACT DISCLOSURES (ALBERTA)

Pursuant to the Internet Sales Contract Regulation (Alberta), the following disclosures are provided to you prior to entering into any transaction on this Site:

  • Description of Goods: Rental of mobile wood-burning sauna trailers, cold plunge tubs, and associated wellness accessories.
  • Currency: All prices are quoted in Canadian Dollars (CAD).
  • Cancellation Rights: You have a statutory right to cancel an internet sales contract as defined in Section 7 below.

3. BOOKING AND PAYMENT

  • Reservations: A booking is not confirmed until you receive a “Booking Confirmation” email and payment has been processed.
  • Pricing Errors: We strive for accuracy, but errors may occur. In the event of a pricing error on the Site, we reserve the right to cancel any orders placed at the incorrect price, even if the order has been confirmed. We will refund the full amount paid in such cases.
  • Security Deposit: A pre-authorization hold of $500.00 is required for all rentals to cover potential damages, theft, or excessive cleaning. This is not a charge, but a hold on your credit limit.

4. RENTAL AGREEMENT INCORPORATION

By booking a sauna through this Site, you agree that the transaction is further governed by the Mobile Sauna Rental & Service Agreement, which will be provided to you for digital signature. That Agreement includes:

  • Assumption of Risk: You acknowledge that sauna use involves heat, fire, and water, which carry inherent risks of injury.
  • Waiver of Liability: You agree to waive claims of negligence against the Operator to the extent permitted by law.
  • Operational Rules: You agree to abide by the “Cold Stove” policy, ash disposal rules, and prohibited items list.
  • Biohazard Fees: You acknowledge that specialized cleaning fees apply for biohazard contamination.

5. LIMITATION OF LIABILITY (WEBSITE USE)

To the fullest extent permitted by law, Bliss Sauna Inc. shall not be liable for any direct, indirect, incidental, or consequential damages arising from:

  1. Your use of or inability to use the Site or booking engine.
  2. Errors, mistakes, or inaccuracies of content on the Site.
  3. Any interruption or cessation of transmission to or from the Site.
  4. Unauthorized access to our secure servers and/or any personal/financial information stored therein.

“AS IS” DISCLAIMER: The Site and its content are provided on an “as is” and “as available” basis without any warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.

6. INTELLECTUAL PROPERTY

All content on this Site, including text, logos, images, and software, is the property of Bliss Sauna Inc. and is protected by Canadian copyright and trademark laws. You may not use, reproduce, or distribute any content without our prior written permission.

7. STATUTORY CANCELLATION RIGHTS (ISCR)

You may cancel this contract from the day you enter the contract until 7 days after you receive a copy of the contract if we do not disclose the information required under section 3 of the Internet Sales Contract Regulation (Alberta).

You may also cancel the contract within 30 days if we do not provide you with a copy of the contract within 15 days of the transaction.

8. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. You hereby attorn to the exclusive jurisdiction of the Courts of Alberta for any disputes arising from these Terms or your use of the Site.

9. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes indicates your acceptance of the new Terms.
