CANCELLATION, REFUND, AND DAMAGES POLICY

Effective Date: January 24, 2026

Governing Legislation: Personal Information Protection Act (Alberta) (“PIPA”)

1. PREAMBLE: LIQUIDATED DAMAGES VS. PENALTIES

The Renter acknowledges that Bliss Sauna Inc. (“the Operator”) incurs significant costs immediately upon the confirmation of a booking. These costs include administrative processing, crew scheduling, inventory allocation, and the removal of the Equipment from the available market. Furthermore, late cancellations result in a loss of rental opportunity that is often impossible to recover.

Therefore, the parties agree that the retention amounts listed in this policy constitute Liquidated Damages—a genuine pre-estimate of the Operator’s lost opportunity, administrative burden, and marketing costs—and are not intended as penalties.

2. STANDARD CANCELLATION TIERS

Refund eligibility is determined by the timing of the cancellation notice relative to the scheduled Rental Start Date.

  • Grace Period (24 Hours): Cancellations made within 24 hours of the initial booking timestamp are eligible for a 100% Refund, provided the Rental Period is at least 72 hours away. (Note: A deduction for non-recoverable payment processing fees may apply).
  • Standard Notice (> 8 Days): For cancellations made more than eight (8) days prior to the Rental Start Date, the Renter shall receive a 50% Refund of the Rental Fee. The Operator retains 50% as Liquidated Damages to cover administrative overhead and loss of booking window.
  • Late Notice (4 – 7 Days): For cancellations made between four (4) and seven (7) days prior to the Rental Start Date, the Renter shall receive a 25% Refund of the Rental Fee. The Operator retains 75% as Liquidated Damages.
  • Short Notice (< 72 Hours): For cancellations made less than 72 hours (3 days) prior to the Rental Start Date, the booking is NON-REFUNDABLE. The Operator retains 100% of the Rental Fee.

3. MITIGATION OF DAMAGES (REIMBURSEMENT UPON RE-RENTAL)

Notwithstanding the “Short Notice” retention policy above, the Operator acknowledges its common law duty to mitigate damages.

  • Re-Booking Effort: If the Renter cancels within the Non-Refundable period, the Operator will make commercially reasonable efforts to re-rent the Equipment for the same dates (e.g., by posting “Last Minute Availability” to social media channels).
  • Conditional Refund: If the Operator successfully re-rents the Equipment for the entirety of the cancelled Rental Period at the full rental rate, the original Renter shall be entitled to a refund of the Rental Fee, subject to the following deductions:
  1. A Re-Booking Administrative Fee of $75.00 (plus GST) to cover the costs of marketing the vacancy, staff time for rescheduling, and processing the new reservation; and
  2. Any Non-Recoverable Payment Processing Fees (estimated at 2.9% + $0.30) incurred by the Operator during the initial transaction.
  • Partial Re-Rental: If the Equipment is re-rented for only a portion of the period, or at a discounted rate (e.g., a “Flash Sale”), the refund will be pro-rated. The original Renter will be reimbursed only the amount of revenue actually recovered from the new booking, minus the Administrative Fee.
  • No Guarantee: The Renter acknowledges that last-minute vacancies are difficult to fill. The Operator makes no guarantee that a replacement renter will be found.

4. RESCHEDULING POLICY

  • Standard Rescheduling: Rescheduling is permitted one (1) time if requested at least 14 days prior to the Rental Start Date. A $50.00 Rescheduling Fee will apply to cover administrative adjustments.
  • Finality: Any booking that has been rescheduled becomes strictly non-refundable and cannot be cancelled for a refund at a later date, regardless of the notice period.

5. WEATHER AND FORCE MAJEURE

Rentals proceed rain, snow, or shine. Cancellation due to weather is permitted only if:

  1. Environment Canada issues a severe weather warning (e.g., Extreme Cold Warning below -30°C, Severe Blizzard) active for the delivery location during the Rental Period; AND
  2. Local authorities (e.g., RCMP, 511 Alberta) declare roads unsafe for travel, preventing the delivery crew from safely reaching the site.

In such cases, the Renter will receive a Credit for the full value of the booking to be used within 12 months. No cash refunds will be issued for weather-related cancellations unless the Operator is unable to deliver due to safety concerns.

6. STATUTORY RIGHTS (ALBERTA CONSUMER PROTECTION ACT)Pursuant to the Internet Sales Contract Regulation, the Renter may have a statutory right to cancel the Rental Agreement within seven (7) days of receiving a copy of the contract if the Operator has failed to disclose the prescribed information required under Section 3 of the Regulation. Nothing in this policy is intended to negate or restrict such statutory rights.
